Experience
After graduating from Canterbury with an LLB in 1987 Malcolm began work in Wellington, before returning to Christchurch. A former partner of Helmore Macdonald and Stanley, Malcolm gained wide experience in all aspects of private practice. He then joined the litigation team of Wynn Williams & Co in 2000. Malcolm left that partnership in 2004 to practice as an attorney in the Turks & Caicos Islands in the Caribbean, before joining the Independent Bar in 2006.
Malcolm has a wide range of experience in commercial and property litigation, insolvency and relationship property. He also has a particular interest in trust litigation, including challenges to wills and the validity of trusts, and the actions of trustees. Malcolm is the author of the Variation and Resettlement of Trusts chapter of the 2nd edition of Equity and Trusts in New Zealand (Thomson Reuters).
A strong believer in the place of alternative methods of resolving disputes, Malcolm became a Fellow of AMINZ in 2012 and has developed his arbitration and mediation practice. Malcolm is a member of the Arbitration, Mediation, and Family Law Arbitration Panels of AMINZ. Malcolm has been a Facilitator for GCCRS (Greater Christchurch Claims Resolution Service) helping parties resolve Earthquake claims, and is now a member of the Fairway Natural Hazards Cover Dispute Resolution Panel.
Malcolm is regularly appointed by High Court Judges and counsel to facilitate expert witness conferences.
Malcolm is the President of AMINZ .
Malcolm was a Council member of the NZ Bar Association from 2010 to 2015 holding office as Secretary, Treasurer, and South Island Vice-President.
